Insurance Claim Denials (including CPP Disability)
If your insurance claim is denied by your insurance company, you do not necessarily have to accept their decision. If you have faithfully paid your premiums, you are entitled to the coverage you paid for.
We represent people whose claims for insurance benefits have been wrongfully denied by an auto, homeowner’s, health, life, or disability insurer.
For example, if you become disabled and file a claim under your disability insurance policy, your claim may be denied because the insurance company disputes the nature, cause, or severity of your disability. Or they may say that the policy does not cover your type of disability, or that you already had the condition prior to signing your policy.
If your disability prevents you from working, you may apply for Canada Pension Plan Disability benefits. If your application is denied, there are three levels of appeal. The first stage is less formal and involves writing to CPP requesting that they reconsider your application, and providing your reasons and information needed to support the request. If you are denied again, you may request a Review Tribunal hearing. We can represent you to ensure you have a fair hearing and to help ensure the ultimate decision is based on a clearly stated medical opinion and on the current law. You can read about the various levels of review here.
